These Terms of Service ("Terms") govern your use of the FTPix mobile application and website (ftpix.in) operated by FTPix Technologies ("FTPix", "we", "us"). By using FTPix, you agree to these Terms.
1. Acceptance of Terms
By creating an account or using FTPix, you confirm that you are at least 18 years old and agree to be bound by these Terms. If you are using FTPix on behalf of a business, you represent that you have the authority to bind that business to these Terms.
2. Your Account
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately if you suspect unauthorized access to your account
- One person or business may not maintain more than one free account
3. Use of Service
FTPix provides photo transfer, cloud storage, and gallery sharing for photographers. You agree to use the service only for its intended purpose and not to:
- Upload illegal, harmful, or obscene content
- Infringe on the intellectual property rights of others
- Use the service to distribute spam or malware
- Attempt to reverse engineer, hack, or disrupt the service
- Resell or redistribute the service without permission
- Exceed the limits of your subscription plan through automated means
- Use the service to store content unrelated to photography
4. Photo Ownership & License
You own your photos. FTPix does not claim any ownership of the photos you upload. By uploading photos, you grant us a limited license to:
- Store and serve your photos through our cloud infrastructure
- Generate thumbnails and resized versions for gallery display
- Deliver your photos to people you share gallery links with
This license ends when you delete your photos or close your account.
5. Gallery Sharing
- When you share a gallery link, anyone with the link can view and (if enabled) download the photos
- You are responsible for who you share gallery links with
- You can disable galleries, set passwords, or set expiration dates at any time
- We are not responsible for photos that have already been downloaded by gallery viewers
6. Subscription Plans & Billing
- Free plan: Available at no cost with limited features as described on our pricing page
- Paid plans: Billed monthly or annually as selected at the time of purchase
- Prices are in Indian Rupees (₹) and are inclusive of applicable taxes
- Payment is processed securely through Razorpay
- Subscriptions auto-renew unless cancelled before the renewal date
- You can upgrade, downgrade, or cancel your subscription at any time from the app
7. Storage Limits
- Each plan includes a specified amount of cloud storage
- If you exceed your storage limit, new uploads will be paused until you free up space or upgrade
- Existing photos will remain accessible even if you exceed limits
8. Service Availability
We strive to keep FTPix available 24/7, but we do not guarantee uninterrupted service. We may occasionally need to perform maintenance or updates. We will notify you in advance of any planned downtime when possible.
9. Data & Backups
- While we take reasonable measures to protect your data, we recommend keeping your own backups of important photos
- We are not liable for data loss due to factors beyond our control
- Photos are stored on Amazon Web Services (AWS) with encryption and redundancy
10. Intellectual Property
The FTPix name, logo, software, and website design are the intellectual property of FTPix Technologies. You may not copy, modify, or distribute any part of the FTPix service without our written permission.
11. Termination
- You can close your account at any time from the app settings
- We may suspend or terminate accounts that violate these Terms
- Upon termination, your photos will be retained for 30 days, then permanently deleted
- Any outstanding payment obligations survive termination
12. Limitation of Liability
To the maximum extent permitted by law, FTPix shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Disclaimer of Warranties
FTPix is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the service will be error-free, secure, or available at all times.
14. Governing Law
These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of India.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of FTPix after changes constitutes acceptance of the updated Terms.
